General Work Terms and Client Responsibilities & Liabilities

All site content (text and multimedia) will be the sole responsibility of the client to provide to Power2Create.in (P2L Impact Learning Empowers Pvt Ltd). Such content should be provided prior to commencing the work and throughout the work if required.

Client is solely responsible to take proper back-up of all content on their site prior to letting Power2Create.in (P2L Impact Learning Empowers Pvt Ltd) undertake the required course of action towards meeting the contract. Any loss or damage to existing data shall not be a responsibility of Power2Create.in (P2L Impact Learning Empowers Pvt Ltd) under any circumstances.

The Contract does not hold Power2Create.in (P2L Impact Learning Empowers Pvt Ltd) responsible for any data entry, web hosting or custom artwork/graphics related work/tasks unless otherwise specifically mentioned, paid for and agreed to by both the parties towards such. Any artwork, images, or text supplied and/or designed by Power2Create.in (P2L Impact Learning Empowers Pvt Ltd) on behalf of the client, will remain the property of Power2Create.in (P2L Impact Learning Empowers Pvt Ltd) and/or it's suppliers unless otherwise agreed.

While Power2Create.in (P2L Impact Learning Empowers Pvt Ltd) will do its best to achieve all deliveries within the estimated time, there may, at times, be the need to extend or adjust time in cases of any unavoidable and non-forecasted situations like those of deployment issues, dependencies, 3rd-Party support, development bottle-necks, resource unavailability due to emergency, communication delays and the like.

Power2Create.in (P2L Impact Learning Empowers Pvt Ltd) will provide the Client an opportunity to review the appearance and content of the Web site during the design and once they are completed. Power2Create.in (P2L Impact Learning Empowers Pvt Ltd) shall wait for a period of 7 days to hear any feedback on such shared work/outputs from the client. In the event of client not replying within this period, such material will deemed to have been automatically accepted and approved by the Client.

The Client retains the copyright to data, files and graphic logos provided by the Client and grants Power2Create.in (P2L Impact Learning Empowers Pvt Ltd) the rights to publish and use such material. The Client must obtain permission and rights to use any information or files that are copyrighted by a third party. The Client is further responsible for granting Power2Create.in (P2L Impact Learning Empowers Pvt Ltd) permission and rights for use of the same and agrees to indemnify and hold harmless Power2Create.in (P2L Impact Learning Empowers Pvt Ltd) from any and all claims resulting from the Client's negligence or inability to obtain proper copyright permissions. A contract for Web site design and/or placement shall be regarded as a guarantee by the Client to Power2Create.in (P2L Impact Learning Empowers Pvt Ltd) that all such permissions and authorities have been obtained. Evidence of permissions and authorities may be requested.

Power2Create.in (P2L Impact Learning Empowers Pvt Ltd) will not accept responsibility for any alterations caused by the Client or a third party occurring to the Client's pages/website once installed/deployed. Such alterations include, but are not limited to additions, modifications or deletions. Power2Create.in (P2L Impact Learning Empowers Pvt Ltd) may require a one-off Web Development charge before resolving any issues that may arise.

Product and Service Information

The description provided on this site about our products and services is as accurate as possible. However it may contain inaccuracies or errors and might not be current or complete, we reserve the right to correct, update or change any kind of information, omissions, errors or inaccuracies relating to the products and services at any given time without prior notice. Re-work, Enhancements/Add-ons and Billing

Any additional features not envisaged in the scope of work would be entertained through a Change Management process and be additional billed. Scope Creeps after wireframe sign off would be billed as additional and time lines and cost for delivery would increase.

Most tweaks such as minor changes/re-work are normally just completed, however, if we feel this is being abused, we will build a list of works found being the grounds of abuse and bill such additionally per the total time efforts involved and undertaken to achieve the work/tasks at business rates ranging from 15 K to 50 k INR per hour.

Whilst we try our best to cover most changes within the budget of the site, some changes are classified as enhancements/add-ons to the system and become chargeable; we will advise you before we start work of any such items.

Any re-work, change or tweak request by the client post approval and/or furthering to the subsequent stage of project process shall be treated as add-on work and be additionally billed.

The client must pay the fee charged by Power2Create.in (P2L Impact Learning Empowers Pvt Ltd) without any deductions, discounts or debt settlement by the agreed due dates.

Terms of Use

Any and all use of this Site is subject to, and constitutes acknowledgment and acceptance of, the following Terms and Conditions ("Terms"). It is mandatory for all users of the website to have read carefully, fully understood and be in total agreement to the below mentioned Terms before they proceed to use the Site.

Payment for Memberships

All payments for services at various portals owned and managed by Power2Create.in have to be made in favour of "P2L Impact Learning Empowers Pvt. Ltd."only. All payments need to be made on 100% advance basis to continue to use uninterrupted Paid Services.

We have not authorized any individual or organization to collect payments in any other name (i.e. any other individual or organization name) or via personal indian Union or personal Paypal Accounts for any services rendered by Power2Create.in(P2L Impact Learning Empowers Pvt Ltd). You are informed that under no circumstances will Power2Create.in(P2L Impact Learning Empowers Pvt Ltd) be liable for any damage caused due to your transactions/payments made to/in favour of such fraudulent individuals or organizations. To protect your interests, please contact us immediately if any such fraudulent individual or organization tries to mislead you.

The User, who is liable to pay Subscription Fees, shall pay it on demand even if the User disputes the same for any reason. In the event that the Company deciding the dispute to be in the User's favor, the Company shall refund to the User any excess amount paid by the Member free of interest. In the event of late payment by the User of any sums due under this Agreement, the Membership and the services would stand terminated.

Refund / Money Back Policy

Once subscribed, the payment made by the User for Paid service is not refundable and no claim for refund would be entertained. Power2Create.in (P2L Impact Learning Empowers Pvt Ltd) neither offers any guarantees for the accuracy, timeliness, authenticity nor advocates any of the content posted by the other Users. All the services are on a best effort basis.

Refund on the basis of fraudulent transactions

The User is solely responsible for maintaining confidentiality, as well as all the activities and transmission performed through his My Folder. He/she shall be solely responsible for carrying out any online or off-line transaction involving credit cards/debit cards or such other forms of instruments or documents for making such transactions.Power2Create.IN (P2L Impact Learning Empowers Pvt Ltd) assumes no responsibility or liability for their improper use of information relating to such usage of credit cards/debit cards used by the subscriber online/off-line.

Refund on the basis of fraudulent transactions

As we at Power2Create.IN(P2L Impact Learning Empowers Pvt Ltd) keep up high interactions with our clients and carry out the entire process with their approval thus there is no provision for any kind of full or partial refund.

Once an order is placed it cannot be cancelled as it is sent for processing immediately. Your personal preferences changed in the course of time, cannot serve a reason for refund or charge back.

Indemnification

Any loss, damages, expenses or liability suffered by Power2Create.in (P2L Impact Learning Empowers Pvt Ltd) or to any third party due to claims arising out of your actions or inactions directly or in directly related must be indemnified by you. Client is solely responsible to take proper back-up of all documents and data on their personal drive prior to letting Power2Create.in (P2L Impact Learning Empowers Pvt Ltd) undertake the required course of action towards meeting the contract. Any loss or damage to existing data shall not be a responsibility of Power2Create.in (P2L Impact Learning Empowers Pvt Ltd) under any circumstances.

The Contract does not hold Power2Create.in (P2L Impact Learning Empowers Pvt Ltd) responsible for any other data entry, creation of new data or custom data/documents related work/tasks unless otherwise specifically mentioned, paid for and agreed to by both the parties towards such. Any data creation idea identification & assessment, legal foundation documents creation, financial creations, business planning documents creation, investors pitch deck, term sheet creation or any text supplied and/or designed by Power2Create.in (P2L Impact Learning Empowers Pvt Ltd) on behalf of the client, will remain the property of Power2Create.in (P2L Impact Learning Empowers Pvt Ltd) and/or it's suppliers unless otherwise agreed.

While Power2Create.in (“Site”) under (P2L Impact Learning Empowers Pvt Ltd) “Business” will do its best to achieve all deliveries within the estimated time, there may, at times, be the need to extend or adjust time in cases of any unavoidable and non-forecasted situations like those of any project dependencies issues, client data dependencies, 3rd-Party support, incubation support journey bottle-necks, resource unavailability due to emergency, communication delays and the like.

Power2Create.in “Site” under (P2L Impact Learning Empowers Pvt Ltd) “Business” will provide the Client (New Ventures or startup or existing ventures) an opportunity to review the appearance and content and data of the incubation work during the designing the work breakdown structure and once they are completed. Power2Create.in (P2L Impact Learning Empowers Pvt Ltd) shall wait for a period of 7 days to hear any feedback on such shared work/outputs from the client (New Ventures or startup or existing ventures). In the event of client (New Ventures or startup or existing ventures) not replying within this period, such material will deemed to have been automatically accepted and approved by the Client(New Ventures or startup or existing ventures).

The Client (New Ventures or startup or existing ventures) retains the copyright to data, files and graphic logos provided by the Client (New Ventures or startup or existing ventures) and grants Power2Create.in (P2L Impact Learning Empowers Pvt Ltd) the rights to publish and use such material. The Client (New Ventures or startup or existing ventures) must obtain permission and rights to use any information or files that are copyrighted by a third party. The Client (New Ventures or startup or existing ventures) is further responsible for granting Power2Create.in (P2L Impact Learning Empowers Pvt Ltd) permission and rights for use of the same and agrees to indemnify and hold harmless Power2Create.in (P2L Impact Learning Empowers Pvt Ltd) from any and all claims resulting from the Client's (New Ventures or startup or existing ventures) negligence or inability to obtain proper copyright permissions. A contract for incubation support and/or placement shall be regarded as a guarantee by the Client (New Ventures or startup or existing ventures) to Power2Create.in (P2L Impact Learning Empowers Pvt Ltd) that all such permissions and authorities have been obtained. Evidence of permissions and authorities may be requested.

Power2Create.in (P2L Impact Learning Empowers Pvt Ltd) will not accept responsibility for any alterations caused by the Client or a third party occurring to the Client's (New Ventures or startup or existing ventures) data or any documents in regards to incubation support once done/approved and handed over to clients. Such alterations include, but are not limited to additions, modifications or deletions. Power2Create.in (P2L Impact Learning Empowers Pvt Ltd) may require a one-off incubation support charge before resolving any issues that may arise.

Re-work, Enhancements/Add-ons and Billing

Any additional work or data creation or incubation support not envisaged in the scope of work would be entertained through a Change Management process and be additional billed. Scope Creeps after incubation support details sign off would be billed as additional and time lines and cost for delivery would increase.

Whilst we try our best to cover most changes within the budget of the incubation support, some changes are classified as enhancements/add-ons to the work/system and become chargeable; we will advise you before we start work of any such items.

Any re-work over approved data, change or tweak request by the client post approval and/or furthering to the subsequent stage of incubation support project process shall be treated as add-on work and be additionally billed.

The client must pay the fee charged by Power2Create.in (P2L Impact Learning Empowers Pvt Ltd) without any deductions, discounts or debt settlement by the agreed due dates.

Terms of Use

Any and all use of this data and documents created during incubation support is subject to, and constitutes acknowledgment and acceptance of, the following Terms and Conditions ("Terms"). It is mandatory for all stake holder of the client to have read carefully, fully understood and be in total agreement to the below mentioned Terms before they proceed to use the project/data/work done.

The Company holds the right to change/modify the terms and conditions at any point of time with prior information in this regard to the concerned stakeholders.

The Services are available only to those individuals, firms or companies who can form legally binding contracts under the Indian laws. If you are not in acceptance of any of the contents mentioned in the Agreement, you may neither use any of the Services nor access the Site.

The content of the Site is for your general information and use only and is subject to change without any prior notice or notification.

All the content made available to us by you is entirely your responsibility and would not hold Power2Create.in (P2L Impact Learning Empowers Pvt Ltd) responsible in any manner whatsoever in relation to the user content. You also agree to not motive, engage in or assist others as well as yourself in sharing, displaying, transmitting, uploading and hosting any kind of information that:

To which you do not have a right and belongs to another person.
Is defamatory, harmful, obscene, objectionable, unpleasant, disgusting, pornographic, racial, and invasive of someone’s privacy, unacceptable or motivating any kind of gambling or money laundering or unlawful in anyway.
Is harmful to minors
Infringes any trademark, patent or copyright in any manner
Contravenes any law in force.
Impersonates any other person
Misleads or deceives another in believing that the origin or meaning of such information is grossly unpleasant or offensive in any manner.
Contains any software viruses or computer code, programs, designs or files to destroy or limit the functionality of our computer resources

Intellectual Property Rights

The Site/Company is the sole owner of all the rights to the Content and to all data created by company during incubation support in all aspects. All title, ownership and intellectual property rights in the data or documents created for clients during incubation support and shall remain with the Company as reference of work as incubation support, its affiliates or licensors of the work Content, as the case may be. All rights not otherwise claimed under this Agreement or by the company are hereby reserved.

Idea Assessment documents, legal documents created for clients, financial creation or planning and services marks put on view on this website are solely owned by the Company (P2L Impact Learning Empowers Pvt Ltd) and any personal or commercial use of the same is right of clients. The unauthorized modification, copy, use or publication of the work done during incubation support to clients may give rise to the clients responsibilities.

Termination

Updating/modification/deletion of user's data/ information shall be done on the written request of the user himself or his representative or his authorized person only.

Once an order is placed it cannot be cancelled as it is sent for processing immediately. Your personal preferences changed in the course of time, cannot serve a reason for refund or charge back.

Losses

We reserve right to not be held responsible for any business loss (including loss of saving, contracts, revenue, profits, data and goodwill) or any other consequential loss which cannot be foreseeable by either you or us while rendering our services

Indemnification

This clause shall continue to survive till any termination or expiry of terms of use.

Others

The Company is not responsible for any dispute within the community members/users/visitors.

Nothing contained in the above clauses shall be construed as creating an agency, partnership, or any other form of joint enterprise between us.
